Data protection officer of the HNU

According to Art. 38 para. 3 DSGVO, the data protection officer is not bound by instructions in the performance of his duties and is obliged to maintain confidentiality according to Art. 38 para. 5 DSGVO and Art. 12 para. 2 BayDSG.

The tasks and duties of an official data protection officer are regulated in Art. 39 DSGVO and include in particular

  • Information and advice for managers, processors and employees
  • Monitoring compliance with the DSGVO and special national regulations
  • Awareness raising and training
  • Advice and supervision in relation to data protection impact assessment
  • Cooperation with the supervisory authority

The current crisis situation has confronted the Bavarian universities and colleges, including HNU, with the challenge of creating the conditions within the shortest possible time to ensure that the semester starts as smoothly as possible on April 20. Among other things, this has made a very quick decision for a suitable platform for seminars and other interactive courses unavoidable.

This decision was based on analyses of the German Research Network and its European umbrella organisation since 2018, as well as on the knowledge gained from the exchange of experience between many European universities in recent weeks.

The university and college management in Bavaria are fundamentally convinced that there is no technically viable alternative to Zoom in the current situation. 

The HNU is well aware of the published problems concerning Zoom in terms of data protection and security. 

In addition to the standard license, a contract for order processing has been concluded with Zoom, which eliminates many published critical points with regard to data protection.  Many of the problems that have become known can be avoided by suitable default settings and by centrally coordinated software distribution.

In addition to Zoom, other web conferencing platforms are available, including DFNconf and other locally and externally operated solutions, depending on the application scenario.

At HNU, Zoom is initially licensed for one year to cover the demand during the pandemic period.
